“Zoekmachines mogen niet langer dan 6 maanden gegevens over gebruikersgedrag bewaren. Na een half jaar moet dit soort gegevens worden geanonimiseerd. Bovendien zijn IP-adressen heuse persoonsgegevens. Dat stellen Europese privacywaakhonden. Daarmee stevenen ze rechtstreeks af op een juridische twist met mondiale implicaties”.

Privacywetgeving geldt ook op internet

New Dutch regulations : privacy legislation also applicable for internet. All those that want to publish personal data on the internet need to have permission from the data subjects. People who did not consent to publication of their personal data can demand that their data be immediately removed from the internet.

“Personal data are published on the Internet by government institutions, companies, journalists or individuals in many different ways. Publications on the Internet are generally accessible worldwide, 24 hours per day, to a potentially extensive and highly varied public. The drawback to the benefit of thisgeneral accessibility is that people whose personal data are placed on the Internet, the data subjects, could be at a serious disadvantage due to incorrect, incomplete or unnecessary publication of their personal data.
Personal data must be treated with the same care on the Internet as they are offline. This publication by the Dutch Data Protection Authority (Dutch DPA ) [College bescherming persoonsgegevens (CBP )] provides clarity with regard to the application of the Wet bescherming persoonsgegevens (Wbp) [Dutch Data Protection Act] in cases involving the Internet.
In brief, those persons who (wish to) publish personal data on the Internet, the controllers, must adhere
to the following regulations. Prior to publication:
1 Determine whether the publication serves a legitimate purpose and whether that purpose is consistent with the purpose for which the data were originally obtained.
2 Ensure that publication of the data is justified.
The most important justification for publishing personal data is the consent of the data subjects”.
